Returns Policy

ZETTABYTES Returns Policy

All refund rights under both State and Commonwealth law apply.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and failure does not amount to a major failure. If the failure is minor, we reserve our right to offer to repair only. We reserve the right to not offer a refund.

Please read the following carefully to ensure you are fully aware of your rights under the policy and our obligations to you.

All product returns must be conducted through the original brand where it was purchased.

When you change your mind

  • At ZETTABYTES you have 7 days to return your items (some exclusions apply) for a full refund or exchange, as long as it is returned in a saleable condition with original proof of purchase. The refund will be provided using your original payment method.
  • For the item to be considered to be in a saleable condition, it must be:
    • It is in its original packaging, including instruction manuals and all accessories; and
    • It is unworn, unused, unassembled, in its original condition; and
  • The product is not one where a change of mind return is not available (see below for exclusions).
  • If you can’t provide proof of purchase we will be unable to provide you with refund.

Excluded change of mind items

The following items cannot be returned if you change your mind:

  • Personalised Products
  • Gift cards, phone recharge or third-party gift cards
  • Trading Cards / Card Collection Packs / Card Decks (Example: Pokémon, NBA, Yu-Gi-Oh!, PANINI etc.)

Other products:

ZETTABYTES will accept returns and provide you with a refund (refund will be provided using original payment method) or repair where:

  • The item is faulty or is not of acceptable quality, or
  • The item is not fit for its intended purpose, or
  • The product does not match the sample or our description; and
  • You can present a ZETTABYTES receipt or other adequate proof of purchase

ZETTABYTES may elect to return the product to the manufacturer’s repair agent to determine the nature of the problem. We reserve the right not to offer an exchange, refund or repair where the item fault is a result of misuse or neglect.

Please be aware that data (including, but not limited to, images, music and video) may be lost during the repair process of electrical and electronic products. It is the responsibility of the customer to ensure that all personal data is deleted before return to ZETTABYTES.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair goods.

Physical gift card orders

Physical gift cards cannot be returned if you change your mind. They also will not be exchanged for another denomination or tender such as cash. ZETTABYTES will accept returns where the item is faulty or is not of acceptable quality. Please note that ZETTABYTES is not responsible for and is unable to replace gift cards which are lost or stolen.

Proof of Purchase

Returns, refunds, exchanges or repair requests must be accompanied by any one of the following proof of purchase documents:

  • Register receipt, however you may provide a clear photo of the full ZETTABYTES register receipt
  • Online Invoice
  • Financial statements such as a bank statement, credit card statement (however, when the proof of purchase does not clearly itemise the goods, more than one type of proof of purchase may be required).
  • Online proof of purchase also includes Zip, Afterpay and Paypal statements

Note

When returning a product, you will be asked for information that is relevant to your return, or to satisfy legislative requirements. If you do not provide this information, then we may be unable to process your return.

When returning a product, with adequate proof of purchase, you will be asked for your signature as authorisation of the return transaction. If you do not have adequate proof of purchase, you will be asked to provide photo or other suitable identification containing your full name, signature and expiration date, so that your name and signature can be verified. The identification information you provide may be accessed by authorised ZETTABYTES team members and authorised third parties for the purpose of fraud investigations and fraud protection activities. Information collected will be securely stored for a reasonable period of time and may be used for the purposes of research and analysis, and may be disclosed to Government departments upon request, where required or authorised by law.

Product may not be accepted for return without adequate proof of purchase. This policy does not override ZETTABYTES’s statutory obligations under the consumer guarantees.

ZETTABYTES reserves the right to assess the condition and age of returned goods prior to providing a repair, exchange or refund. This may result in a repair, exchange or refund being refused.

  • Gift cards are not redeemable for cash.
  • Refunds will only be issued using your original payment method ( includes the same card or device as purchase). However, if the original payment method cannot be verified due to a different digital platform, such as mobile payment, watch payment, e-wallet etc. or a card was replaced, then you will be asked for proof of identity. The acceptable forms of proof of identity are:
    • Australian Driver’s Licence
    • Australian Citizenship Certificate
    • Passport
    • Australian document of identity
    • Medicare card
  • Australia Post Key Pass identity card

Privacy

You will be asked for information that is relevant to your return or to satisfy legislative requirement. If you do not provide this information, then we may be unable to process your return. When returning merchandise with proof of purchase, you will be asked for your signature as authorisation of the return transaction. If ZETTABYTES agrees to a return without adequate proof of purchase, you will be asked to provide identification containing your full name. ZETTABYTES will record your name and form of identification provided, which may be accessed by authorised ZETTABYTES team members for fraud protection activities. Information collected will be securely stored for a reasonable period of time and may be used for the purposes of research and analysis, and may be disclosed to Government departments upon request, where required or authorised by law.

Your nearest store

If you live a long way from your nearest ZETTABYTES store, we recommend contacting Customer Support on 0488 40 60 60 for assistance prior to travelling to a store to return your item. Remember also, when returning items in accordance with ZETTABYTES’s Return Policy, you don’t need to return to the store of purchase, you can attend any ZETTABYTES store.

Buy Now Pay Later facilities

If the purchase was made through a buy now pay later facility, the refunded money will be returned to the account held, and the balance will then be adjusted accordingly.

Acceptable User Policy

This policy is subject to change. This policy is in addition to ZettaBytes Terms & Conditions

  1. ZettaBytes reserves the right to suspend or cancel a customer’s access to any or all services provided by ZettaBytes, where ZettaBytes decides that the account has been inappropriately used. ZettaBytes reserves the right to refuse service and/or access to its network to anyone.
  2. ZettaBytes offers large amounts disk space and bandwidth with some account types. By this, we mean disk space for legitimate website content and bandwidth for visitors to view it. All files on a domain must be part of the active website and linked to the site. websites should not contain any backups, or other non-web based content. We will treat all password protected archives (e.g. zip and rar) files as unacceptable. Non web files including, but not limited to exe, mp3, avi, wmf are not permitted on our servers with out prior arrangement.
  3. Scripts and web applications on the website must be designed to produce web-based content, and not to use the server as an application server. Using the server to generate large volumes of email from a database is an example of activity that is not allowed. Scripts and web applications should not attempt to manipulate the timeouts on servers. These are set at the present values to ensure the reliability of the server. Sites that reset these do so because they are resource intensive, and adversely affect server performance and are therefore not allowed. Scripts and web applications that are designed to provide proxy services, anonymous or otherwise, are not allowed.
  4. Scripts and web applications that use excessive resources such as memory or CPU are not permitted on our servers.
  5. The ZettaBytes FTP servers may not be used by persons outside of the account holders organisation to transfer files to our servers. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.
  6. ZettaBytes will disable any website and domain that fails to adhere to the following criteria as soon as we are made aware, in line with current working practices: –
    1. The primary purpose of any website must be to provide web-based content to viewers. Files on the site must be linked to the website.
    2. The primary purpose of any script or web application must be to produce a web page. Scripts and web applications that send a single email based upon user entered information, or update a database are acceptable. Scripts and web applications that send bulk email or perform processor intensive database processes are not allowed. All outgoing mail is monitored and filtered and must be sent using authentication from a ZettaBytes hosted mailbox.
    3. Database services are for the exclusive use of storing the data of websites hosted on our network and can not be used to store non website data.
    4. Websites must not contain Warez, copyright or other illegal material. The onus is on you the customer to prove that you own the rights to publish material, not for ZettaBytes to prove that you do not.
    5. Websites must not contain pornographic or other lewd material. Adult Material includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of ZettaBytes.
    6. Websites must not use excessive amounts of server resources. These include bandwidth, processor utilization and / or disk space. If your website uses large amounts of server resources you will be contacted to look at upgrading your account and or suspending it until further notice.
    7. Websites must not contain scripts and web applications that attempt to access privileged server resources, or other sites on the same server.
    8. FTP Services are for the exclusive use of our customers and our resellers customers and may not be used for anonymous or pubic FTP access.
    9. Email Services are for the exclusive use of our customers and our resellers customers and may not be used for Free Email Services or Free Mailbox Services.
  7. If you are found to have illegal files stored on our systems then your account will be suspended and all files removed without warning.The designation of “illegal files” is left entirely to the discretion of ZettaBytes.

Terms & Conditions

By placing an order with ZettaBytes, you confirm that you are in agreement with and bound by the terms and conditions below.

Definitions

The Client: The company or individual requesting the services of ZettaBytes.
ZettaBytes: Employees or affiliates

General

ZettaBytes will carry out work only where an agreement is provided either by email or post mail.
An ‘order’ is deemed to be a written contract between ZettaBytes and the client, this includes email agreements.

Hosting setup

It is your responsibility to ensure that any applied hosting package application is completed and activated ready for full use. Quoted times for account activation are estimates and we do not guarantee or imply activation within the quoted time frame. We may delay or refuse activation if:Payment is not cleared or received in full

  • We believe the order, information or payment is fraudulent
  • You have any funds outstanding with relation to any other account
  • The domain name quoted does not exist, is in a non-usable state (e.g pending renew) or deemed to be proposed for use that voids our Acceptable Use policy
  • There is any other reason which we deem satisfactory

We may send notification of hosting activation however:

  • Your contact details must be correct and up to date
  • This is not final word that your hosting is fully active and ready for use, you must ensure the hosting is fully functional

You release us of any claim arising from failed hosting activation whether at fault of our system, our staff or any other factor out of our reasonable control.

Loss of service

We will endeavor to maintain network stability and satisfactory service levels, however:

  • We may from time to time perform routine maintenance, service and upgrades. We will endeavor to act on such instances at the most convenient times and provide reasonable notice by any means we deem satisfactory
  • We may experience outages beyond our control caused by any of the following; force majeure (any ‘act of god’ including those induced by negative human activities), war, invasion, act of hostilities, civil war, rebellion, military power or confiscation, terrorist activities, nationalism, governmental/quasi-governmental sanction, restraint, embargo, prohibition or intervention, blockage, labour dispute, general strike, lockout or failure of utilities (electricity, telephone, etc), failure of hardware (our hardware as well as third party), failure of software, failed software or hardware upgrade or any other failure as caused by ZettaBytes, our suppliers or any third party
  • We may, at our discretion provide notification of outages whether planned or unplanned
  • You release us from any claim or potential claim with relation to outages and any loss of business/service suffered by you or any third party
  • Down time can never be 100%, guaranteed however if your account drops below 99% uptime over a 12 month period we will grant 1 month free hosting to each client effected

Backups

We run weekly backups of all shared hosting accounts and does not include virtual dedicated server, dedicated servers and or other services. Our backups that are run weekly are a free complimentary service. There is no guarantee on any backups. Backups are the FULL responsibility of the customer. ZettaBytes will not be held accountable for data loss of any kind.

Payment

If any payment due from you to us is not received by the due date, we gives a 7 day grace period, after this date your account will be suspended until payment or a payment arrangement has been approved and received.

We do not charge a suspension/late fee & or re-connection after suspension is put in place.

Suspension and Cancellation

We reserve the right to suspend/cancel any/all service, including all domain names if:

  • You have any outstanding invoice or account
  • Your account is in dispute or dispute resolutions procedure, court order, judgement, findings or determination
  • You fail to comply with any provision in this agreement or those referenced in this agreement
  • There is evidence of fraudulent, illegal, defamatory, offensive activities, or any activity in breach of a third party’s rights
  • We deem your use of our services may jeopardize the operation of the service, ZettaBytes or our suppliers
  • We deem any other reason as satisfactory to protect ZettaBytes, our staff and/or our suppliers
    Once again if suspension does take place we do not charge re-connection or suspension fees, However we will not activate the account again until payment or a payment arrangement has been approved and received.
  • Bandwidth an extra services which are limited on some plans are not charged at an extra cost, you may request to have more bandwidth implemented by our support team, this may or may not come at a charge and is at the discretion of the ZettaBytes staff member. We will not charge you anything for extra bandwidth if any without your written permission.

Acceptable Usage

It is your responsibility at all times to:

  • Use our service and services in a manner which does not violate any applicable laws or regulations
  • Respect the conventions of the newsgroups, lists and networks that you use
  • Respect the legal protection afforded by copyright, trademarks, license rights and other laws to materials accessible via our service;
  • Respect the privacy of others
  • Use the service in a manner which does not interfere with or disrupt other network users, services or equipment; and
  • Refrain from acts that waste resources or prevent other users from receiving the full benefit of our services
  • Ensure your use of our services remains ethical and in accordance with accepted community standards
  • You must at all times comply with law. You will be in breach of this policy on violation of state, federal or international laws.

It is not acceptable to use our service(s) to:

  • Violate copyright or other intellectual property rights;
    • Illegally store, use or distribute software; transmit threatening, obscene or offensive materials
  • Engage in electronic ‘stalking’ or other forms of harassment such as using abusive or aggressive language
  • Misrepresent or defame others
  • Commit fraud
  • Gain unauthorised access to any computing, information, or communications devices or resources, including but not limited to any machines accessible via the Internet
  • Damage, modify or destroy the files, data, passwords, devices or resources of ZettaBytes, other users or third parties
  • Engage in misleading or deceptive on-line marketing practices;
  • Conduct any business or activity or solicit the performance of any activity that is prohibited by law
  • Make an unauthorised transmission of confidential information or material protected by trade secrets
    “Spam” or engage in “spamming” activities
  • Engage obscene speech or materials, this includes, advertising, transmitting, storing, posting, displaying or otherwise making available; child pornography, offensive sexual content or materials or any other obscene speech or material
  • Post or transmit defamatory, harassing, abusive or threatening language
  • Create, distribute or provide information/data regarding internet viruses, worms, Trojan horses, pinging, flooding, mail-bombing or denial of service attacks;
  • Facilitating a violation of this Acceptable Use Policy
  • Perform any other action through utilization of any service which we deem unsatisfactory
  • Attempt to do any of the above

You agree that we may at our discretion and by order of any law enforcement agency disclose information relating to your account and use of services. We may also report any action we find in breach of this agreement, local, state, federal or international laws and cannot be held liable for any outcome resulting in our actions.
Any breach of our AUP can result in immediate termination of services and loss of all data held on provided services. You release us, our staff and our suppliers of any liability resulting in such instances.

Liability and indemnity

You agree that we shall have no liability to you or any other person with respect to any loss of service, data, business, indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profit/goodwill for any matter whether such liability is asserted on the basis of contract, tort, breach of warranties either expressed or implied.
You agree to defend, indemnify, save and hold us, our staff and suppliers from any and all demands, liabilities, losses, costs and claims, including reasonable legal fee’s asserted against us, our agents, our clients, our offices and employees, that may arise or result from any service provided, performed or agreed to be performed or any product sold by a customer, their agents and employees.

You agree to defend, indemnify, and hold us harmless against liabilities arising out of:

  • Any injury to person or property caused by any products sold or otherwise distributed in connection with ZettaBytes
  • Any material supplied by the customer infringing or allegedly infringing on the proprietary rights, legal and/or civil rights of a third party
  • Any breach of any representation or warranty provided herein
  • Any negligence or wilful misconduct by you
  • Any allegation that your account infringes a third person’s copyright, trademark, or intellectual property right, or misappropriates a third person’s trade secrets
  • Any defective products sold to customers from our server

By accessing any service hosted on our network you understand, agree and are bound to this indemnification and any other indemnification mentioned in our service agreement and agreements referenced to therein. Should we be notified of pending legal action or intention to seek legal advice, we may seek written confirmation from you concerning your obligation to indemnify ZettaBytes. Failure to provide such confirmation may be considered a breach of this agreement. We cannot be held responsible for any damages your business/operation may suffer. We provide no warranties, expressed or implied, for service we provide. Nor do we guarantee your web site or applications will be error free on our servers. We are not responsible for loss of data resulting from delays, software incompatibility, hardware or software issues, outages, failed deliveries and any service interruption caused by ZettaBytes, our employees or our suppliers. Should any part of this policy be made invalid by relevant legislation, the remainder of the policy shall remain in force.

Refund Policy For New Accounts

We have a 30-day money back guarantee on all new hosting accounts. If you are not completely satisfied with our services within the first 30 days of your contract, you will be given a full refund of the contract amount excluding setup fees. Setup fees are refundable for the following reasons only:

  1. The account order is cancelled prior to activation
  2. No refunds are available after the 30th day or if he has violated our Terms of Service .
    Additional services such as data transfer overages, disk space, pop accounts, domain registration fees, etc. are non-refundable.

All cancellations must be received in writing as per the deadlines indicated; regular mail, e-mail notifications are acceptable.

Phone requests will not constitute acceptance of any cancellation.

  • Domain name registrations are not refundable.

Refund Policy for Renewals

All Renewals of web hosting contracts will be refunded if ZettaBytes is notified before 15 days of the due invoice date. No refunds will be granted for notifications received after this date.Additional products such disk space, POP accounts, e-mail forwarding, and auto-responder are refundable if, within the first 10 days before account renewal, either of the following conditions exists:

  1. The hosting account is cancelled
  2. You cancel any additional products (disk space, POP accounts, e-mail forwarding, and auto-responder ) under the hosting account.

It is important for users to contact ZettaBytes at least 15 days before the renewal date to request non-renewal, cancellation, make any contract length changes, and upgrades/downgrades, etc. This will avoid double work for the renewal billing department and less confusion for you. Please note that contract length changes cannot be processed after the renewal date has passed.

If you know in advance you do not want to renew, You must cancel formally using the client areas “cancel” / “terminate” button under your listed services and accept the terms and conditions to suspend/terminate the service. Phone, email, fax or any other type of communication requests will not constitute acceptance of any cancellation.

Privacy Policy

This policy covers how we use your personal information. We take your privacy seriously and will take all measures to protect your personal information.

Any personal information received will only be used to fill your order. We will not sell or redistribute your information to anyone.
